IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO. 4020 OF 2020 Ms. Alka Shyamsunder Mundhe .. Petitioner

Versus

The State of Maharashtra and others .. Respondents Mr. Sandeep D. Munde, Advocate for the Petitioner. Mr. S. G. Karlekar, AGP for Respondents/State. CORAM : S. V. GANGAPURWALA & R. N. LADDHA, JJ.

DATED : 28th JULY, 2021.

PER COURT:- .

The petitioner has approached this Court against the order rejecting the prayer for interim stay to the advertisement and the process pursuant thereto.

2.

Considering the fact that, the petition is filed challenging interlocutory order, we are not inclined to entertain the present writ petition on merits. It would be inappropriate to stall further process. 3.

Mr. Munde, learned counsel for the petitioner submits that the Tribunal be directed to decide the Original Application on its own merits.

2 997-wp 4020-2020.odt 4.

It is submitted by the learned counsel for the petitioner and the learned A.G.P. that the Tribunal at Aurangabad is functioning. 5.

In view of that, the petitioner may make a request to the Tribunal to decide the Original Application expeditiously. The Tribunal naturally would consider the request of the petitioner and decide it as per its convenience expeditiously considering that the petitioner is assailing the selection process.

6.

With the aforesaid observations, writ petition is disposed of. No costs.

( R. N. LADDHA ) ( S. V. GANGAPURWALA ) JUDGE JUDGE P.S.B.
