Order :- Heard learned counsel for applicant-appellant. Perused the application. Admittedly, notices issued to respondents No. 1 to 3 were returned unserved due to incomplete address and notice of respondent No.3 was returned unserved due to not residing on same address as per the report of bailiff. Therefore, there is no impediment to allow the applicant-appellant to serve the notice to respondents No. 1 to 4 through paper publication.

Accordingly, application stands allowed in terms of prayer clause 'B'. The notice to respondents No. 1 to 4 be served through publication in daily news paper Divya Marathi having circulation in the area of Udgir, District Latur and Pimpalgaon (Amba) Taluke and District Latur.

The Registry to do the needful to facilitate applicantappellant for publication of notice to respondent No.1 to 4 in daily news paper as per rule. Accordingly, application stands disposed of. 4.
