Heard Mr S.S. Dargad holding for Mr S.G. Chapalgonkar, learned counsel for the appellant/applicant. He submits that it is necessary to serve respondent No. 5 by paper publication since earlier attempts are failed to serve him. Respondent No. 5 is stated to be resident of VPO - Manesar, Gurgaon, Haryana State and it is difficult to serve him. 2.

Having considered the submissions of Mr S.S. Dargad, learned counsel for the applicant/appellant, it is necessary to allow this application.

ORDER

(I) The application is hereby allowed in terms of prayer clause (B). (II) The applicant to submit copy of paper publication with supporting affidavit in order to show substituted service upon respondent No. 5. (III) Hamdast allowed.

(IV) The appeal be listed on 09.06.2022.
