The learned counsel for the petitioner submits that, the petitioner has filed an appeal against his disqualification in the month of January 2019. Once it was reserved for judgment, still the same is not decided.

The learned Assistant Government Pleader accepts notice for respondents and states that, in case the appeal is filed by the petitioner and same is pending before the respondent No. 2, then the respondent No. 2 would decide the same in accordance with law.

In the light of the above, in case the appeal is filed by the petitioner and same is pending before the respondent No. 2, then the respondent No. 2 shall decide the same on its own merits, in

2 wp 4054.20 accordance with law, after hearing all the parties concerned, expeditiously and preferably within a period of four (04) months from today.

In view of the above, the writ petition is disposed of. No costs.
