BENCH AT AURANGABAD CRIMINAL APPLICATION NO.1730 OF 2016 IN CRIMINAL APPEAL NO.123 OF 2016 Syed Wahab Sayed Mir Applicant

Versus

State of Maharashtra Respondent Mrs.Ashwini S. Hoge Patil, advocate for the applicant. Mr.D.R.Kale, APP for the Respondent.

CORAM : R.M.BORDE & K.L.WADANE, JJ.

DATE : 21st April, 2016 PER COURT:

This is an application seeking bail by the accused convicted for the offence punishable under Section 302 of the Indian Penal Code.

The accused is charged with the offence of murdering his daughter Mariya and son Syed Kaif. The prosecution case is based on circumstantial evidence, which, according to the learned trial Court, forms a complete chain to connect the accused with the crime.

On perusal of the evidence, we are of the considered view that this is not a fit case for enlargement on bail. The accused-applicant was not granted liberty of remaining on bail during continuance of trial.

{2} crappln173016.odt In this view of the matter, application for grant of bail by the accused-applicant for his enlargement on bail stands rejected. The paper book has been prepared and appeal is ready for final disposal.

Place the appeal for final hearing on 09.06.2015. K.L.WADANE R.M.BORDE JUDGE JUDGE adb/crappln173016
