ORDER :

The application is filed for bail. Both the sides are heard. The papers of investigation were made available to this Court.

The crime is registered at C.R. No. 52/2017 in Nandurbar City Police Station for the offences punishable under sections 395, 336 etc. of Indian Penal Code and some sections of Maharashtra Police Act on the basis of report given by one Chetan Choudhary, who is hotel owner. He has made allegations that on 17.2.2017 at about 10.00 p.m. when he was present in the hotel and beer bar, the present applicant and his associates came there, they caused damage to the articles and furniture of beer bar and they took away cash amount of Rs.10,000/- to Rs.12,000/- from the counter.

In the present matter and Criminal Application No. 1539/2017 the present applicant is involved as accused and there are similar offences. Apparently, they are registered due to rivalry between the owners of two hotels. The present applicant is behind bars since 24.2.2017. In view of these circumstances and as it is not certain as to how much time will be required for disposal of the case, this Court holds that bail needs to be granted to the present applicant.

In the result, the application is allowed. The applicant is to be released on bail on his furnishing PR and SB of Rs. 30,000/- (Rupees thirty thousand) with one solvent surety of like amount. He is not to tamper with the prosecution witnesses. He is not to commit similar offence.
