The Petition was admitted vide order dated 22.06.2009.

Learned counsel for the parties submit that the parties have resolved the dispute amicably and accordingly, they have filed compromise pursis. The comprise pursis filed on record is marked as "X" for identification.

Mr.Arvind Sakharam Shinde, the General Manager of the petitioner bank present along with his Advocate. Mr.Khayum Khajamiya Shaikh - Respondent present along with his Advocate.

The petitioner and the respondent confirmed their respective signatures on the compromise pursis and further submit that the settlement has been reached voluntarily and confirmed the terms of compromise recorded in the compromise pursis. It appears that the parties have amicably settled the dispute voluntarily and the respondent has been authorized to enter into settlement. The settlement is in the interest of both the parties. I am therefore inclined to allow the parties to settle the matter. Hence the following order :-

ORDER

(i) The Petition is disposed of in terms of compromise pursis filed as "X" for identification.

(ii)Parties to bear their respective costs.

(iii) Rule made absolute in above terms.
