Heard the learned counsel for the applicant, the learned APP for the respondents-State and Mr. Narwade-Patil, learned counsel appearing for respondent No. 3.

The applicant is apprehending arrest in connection with Crime No. 78/2024 dated 27.2.2024 registered with Amalner Police, District Jalgaon for the offences punishable under sections 354, 323, 504, 506 of I.P.C. under sections 3(1)(r), 3(1)(s), 3(2)(va), 3(1)(w), 3(1)(w)(i) and 3(1)(w) (ii) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act, 1989 and under sections 11 and 12 of Protection of Children From Sexual Offences Act, 2012.

This Court by order dated 26.3.2025 has granted interim protection to the applicant. The learned counsel for the applicant submits that in pursuance of the interim order of this court, the applicant has cooperated with the investigation. The learned counsel also submits that the investigation is over and the chargesheet is also filed in the matter and as such, custodial interrogation of the applicant is not necessary.

Considering the nature of the offences alleged above and considering the maximum punishment provided for aforesaid offences that may be imposed and considering that the investigation is completed and the chargesheet is filed in the matter and considering that the trial would take substantial time, the interim protection granted on 26.3.2024 can be confirmed.

In view of the above, the application is allowed and the interim protection granted on 26.3.2024 is confirmed on the following terms : i] The applicant shall attend the police station as and when required.
ii] The applicant shall not tamper with the evidence of the prosecution in any manner. He shall not influence the informant, witnesses and other persons concerned with the case. iii] The applicant shall co-operate with the investigation and also in the proceedings before the trial Court.

In the event, the applicant violates any of the conditions specified in this order, it shall be liable to be cancelled. 7.
It is also clarified that the observations made in this order are limited to the disposal of the present anticipatory bail application and the trial Court shall proceed further in the matter without being influenced by the observations made hereinabove.

The application stands disposed of.
