1) It appears that no application is filed by the petitioner to the proper authority and the petitioner has forwarded application directly to this Court. Learned Additional Public Prosecutor submits that enquiry was made with the prisoner but he again submitted that he had applied to the Court.

2 Cr WP 414/2015 2) It is the discretionary power of the authority. So the application needs to be made to the authority first. In view of urgency of the matter the authority is expected to expedite the matter, prior to the date of the marriage. The application already sent to this Court is to be treated as the application to the authority. The petition stands disposed of.
