This petition takes an exception to the order dated 0612-2019, passed by the learned Additional Sessions Judge, Jalgaon in Criminal Revision Application No. 47 of 2017. 2.

An application for return of certain documents was filed by the present petitioner before the learned Magistrate in RCC No. 16 of 2015. The learned Magistrate rejected the said application by the order dated 05-01-2017. Against the said order of learned Magistrate the revision was filed. The learned Additional Sessions Judge, Jalgaon rejected the revision by order impugned. 3.

I have heard the learned counsel for the petitioner and the learned APP for the respondent/State.

The learned APP submits that during further investigation it transpired that accused committed offences punishable under the provisions of the MPID Act. It is submitted that in the year 2020 Section 3 and 4 of the MPID Act came to be added in the crime. It is further submitted that the forensic audit work is still going on. It is submitted that the process of attachment of the property under Section 3 of the MPID Act is also initiated. 5.

Considering the facts and circumstances, the learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to file an application before the Special court at appropriate stage.

The petition is dismissed as withdrawn with liberty as prayed for.
