Heard learned counsel for the applicant. The learned counsel for respondent No.1A to 1C despite appearance, remained absent. The other respondents are served and the application is already dismissed against respondent No.8.

There is delay of 180 days in filing second appeal. There is no oppose to the application. As such, the application is allowed in terms of prayer clause-B subject to cost of Rs.500/- to be paid to the Registry of this court for utilization of Dispensary, High Court, Aurangabad, within two weeks. After deposit of costs, second appeal be registered.
