Heard the learned counsel for the applicant and the learned APP for the respondent-State.

The applicant is seeking bail in Crime No.461 of 2022, registered at Shivaji Nagar Police Station, District Beed, for the offences punishable under Sections 354, 354-D, 376, 376(2) (n), 384, 506 of the IPC and Section 66(C), 67(A) of the Information Technology Act.

3. The prosecution case is that the victim and the applicant meet on Instagram. Then their relations developed. The applicant impersonated him to be a member of Maratha Community, however he was not. He also captured her obscene photographs and videos. The applicant started demanding

money from the victim and threatened her to viral the photographs. Hence, their relations become strained. 4.

The applicant is languishing in jail since November 2022. The investigation has been completed. The relevant material from the custody of the applicant has also been seized. They are residents of different towns and there is no possibility of their meetings. However, to guard the interest of the victim, certain conditions may be imposed while granting bail to the applicant. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant SHAIKH SHARIF SHAIKH RAJJAK be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount, in Crime No.461 of 2022, registered at Shivaji Nagar Police Station, District Beed, for the offences punishable under Sections 354, 354-D, 376, 376(2)(n), 384, 506 of the IPC and Section 66(C), 67(A) of the Information Technology Act, on the following conditions :

(a) The applicant shall not tamper with the prosecution witnesses.

(b) He shall not contact the victim or her relatives on phone or in any other manner or threat them.

(c) He shall attend the trial on each date.
