The applicants have been convicted for the offence punishable under Section 395 of the Indian Penal Code and sentenced to suffer rigorous imprisonment for five years and to pay fine of Rs. 1,000/- each, in default, to suffer simple imprisonment for ten (10) days. The case dates back to 2008. The applicant was in jail for little over 11⁄2 years. The sentence is of five years rigorous imprisonment. It being a short term sentence and the appeal is not likely to be heard in near future.

In the fitness of things, the execution of substantive sentence of imprisonment to stand suspended pending the appeal. The applicants be released on their executing P. R. bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) each with surety bond each in the like amount.
