Cri.Appln.No.1556/17
IN THE HIGH COURT AT BOMBAY
APPELLATE SIDE, BENCH AT AURANGABAD 908 CRIMINAL APPLICATION NO. 1556 OF 2017 RAVINDRA S/O. BHARATSINH GOUR AND ANR.
VERSUS
THE STATE OF MAHARASHTRA AND ANR ...
Advocate for Applicants : Mr. V.P. Raje APP for Respondent/State : Mr. A.R. Borulkar ...
CORAM : T.V. NALAWADE, J.
DATED : April 12, 2017.
ORDER :
1.
The application is filed for relief of anticipatory bail. Both the sides are heard. The papers of investigation including the M.L.C. in respect of complainant was made available for perusal of this Court.
2.
The M.L.C. shows that atleast two injuries are described as probably self inflicted injuries by using sharp cutting object. The learned counsel for applicant has produced affidavit of one Manoj Sallawar showing that when there was some incident of pushing and pulling, the complainant created a show that during incident the gold ornaments were stolen which were on his person, but these ornaments were returned by him to the real brother of the first informant. In the F.I.R., allegations are made that the assault was made by Shivkumar by using
Cri.Appln.No.1556/17 knife and Dharmendrasingh by using axe and due to that he had sustained bleeding injuries. Allegations are made that all the accused, who are four in numbers, have taken the ornaments like gold chain, gold ring and also mobile handset. Though the police report shows that police could not arrest the other accused, who had used dangerous weapons as per the version of the complainant and witnesses, as there are no specific allegations against the present applicants, this Court holds that protection needs to be given to them.
3.
In the result, the application is allowed. Interim relief granted earlier in favour of applicants is confirmed. They are to attend the concern police station on every Saturday and Sunday for the period of one month between 9.00 a.m. and 12.00 noon from today. They are to cooperate the police during investigation.
