Rule. Rule made returnable forthwith. By consent, heard both the sides for final disposal.

It is the grievance of the Petitioner, who had applied for the post of Anganwadi Sevika that the marks secured by her in 10th standard examination, which was more than 80% (81.6%), were not considered and accordingly, weightage was not given to her for considering her performance for recruitment. Submission was made that subsequently she produced her mark list of 10th standard. In the past, she had produced mark list of only 12th standard and so less weightage was given to her. Subsequently, on the basis of marks secured by her in 10th standard, more weightage was given to her and due to that she was ranked first in the selection process and she was given appointment. Copy of the said order is taken on record and it shows that appointment is made subject to the decision of this matter. In view of the aforesaid circumstances, this Court holds that the marks obtained by her in 10th standard examination ought to have been considered as the weightage was to be given on the basis

of those marks and so the petition is allowed. In view of the aforesaid circumstances, no more relief is required to be given. Rule is made absolute on those terms.
