PER COURT :- The petitioner is objecting to the order dated 20.3.2015 passed by the District Returning Officer, Latur District Central Cooperative Bank Limited, Latur.
According to the petitioner, his name was forwarded as a delegate by the Primary Society by adopting a resolution on 14.2.2015. On 16.3.2015, ten out of thirteen members objected to the resolution and as such, the Assistant Registrar suggested to adopt another resolution. Accordingly, a resolution was adopted, thereby recommending the name of Jaydeep Jagganath Shinde and the said name was forwarded to the Returning Officer. The Returning Officer accordingly corrected the name of the representative.
Learned counsel appearing for the petitioner contends that, change in the name of representative was effected after
{2} wp 3556.15.odt 27.2.2015, which is the date prescribed for forwarding name of nominee of society. On consideration of the programme of election it does appear that the time limit prescribed for sending name of nominee is 21.2.2015. However, as provided under the rules, the name of the nominee can be changed after the due date in certain contingencies. The objection raised by the petitioner, therefore, does not deserve consideration. Even otherwise, since the society is represented at the election, the grievances raised by the petitioner in the instant petition, need not be entertained, in exercise of extraordinary jurisdiction under article 226 of the Constitution of India. Petition is devoid of substance and as such stands rejected.
