DATED : 25/09/2023 PER COURT :
CA 6381/23 & Ors.
1.
Heard the learned counsel for the respective parties. Though notice is served on respondent No. 3 in the matters, none appeared for respondent No. 3.
2.
The first appeals are filed along with application for condonation of delay of 1877, 1937 and 1943 days in filing the respective appeals. The learned counsel for the applicants/claimants submits that the claimants are poor agriculturists and that their lands are compulsorily acquired and due to financial difficulties, they could not file appeals in time. The learned counsel further submits that the claimants would waive the interest for the delayed period caused in filing the first appeals. 3.
For the reasons stated in the applications, the aforesaid delay caused in filing the first appeals is condoned. The delay condonation applications are allowed, subject to condition that the claimants shall not be entitled for the interest and statutory benefits for the delayed period. 4.
First appeals are admitted.
5.
On admission, the respective learned AGPs waives service of notice for respondent Nos. 1 and 2 in respective appeals. 6.
