Heard learned counsel Ms. K. M. Daskhedkar hodling for Mr. V. P. Narwade for the applicant, the learned APP Mr. S. K. Shirse for the respondent-State, and the learned appointed Counsel Ms. Meera A. Bhosale for respondent No.2.

The applicant is apprehending arrest in connection with FIR No.0048/2023, dated 21/01/2023, registered at Karjat Police Station, District Ahmednagar, for the offences punishable under sections 395 of the Indian Penal Code.

This Court, by order dated 06/05/2024, granted interim protection to the applicant and directed the applicant to attend the police station. The learned Counsel for the applicant submits that, in pursuance of the order of this Court, the applicant has attended the police station and 1 of
cooperated with the investigation.

The case against the applicant is that on the night of 20/01/2023, the applicant and the co-accused allegedly snatched cash, gold ornaments, and mobile phones from the informant and his wife. 5.
The learned Counsel for the applicant submits that the coaccused in the matter have been arrested and granted bail. The complainant has filed an affidavit at Exhibit 28 before the Sessions Court stating that the entire muddemal property has been received and therefore he has no grievance against the applicant. 6.
As per the police report, there are no antecedents against the applicant. Considering this aspect of the matter and the fact that the applicant has cooperated with the investigation, no further custodial interrogation of the applicant is necessary.

Considering the material on record, including the affidavit at Exhibit 28 noted in the Sessions Court order, and in light of the above circumstances, the interim protection granted to the applicant is confirmed.

In view of the above, the application is allowed in the following terms : - i] In the event the applicant is arrested in connection with FIR No.0048/2023, dated 21/01/2023, registered at Karjat Police Station, District Ahmednagar, for the offences punishable under sections 395 of the Indian Penal Code, he shall be released on bail on furnishing PR bond of Rs.20,000/- with one or two sureties in the like amount to the satisfaction of the trial Court. ii] The applicant shall attend the police station as and when called by the police.
iii] The applicant shall not tamper with the evidence of the prosecution in any manner. He shall not influence the informant, witnesses and other persons concerned with the case. iv] The applicant shall co-operate with the investigation and also in the proceedings before the trial Court. 9.
In the event, the applicant violates any of the conditions specified in this order, it shall be liable to be cancelled. 10.
It is also clarified that the observations made in this order are limited to the disposal of the present anticipatory bail application and the trial Court shall proceed further in the matter without being influenced by the observations made hereinabove. 3 of

The application stands disposed of.

Fees of the appointed advocate is quantified at Rs.10,000/- (in words rupees ten thousand only), to be paid by High Court Legal Services Sub-Committee, Aurangabad.
