The petitioner is before us, being aggrieved by the order passed by the Superintendent, Aurangabad Central Jail, dated 03-03-2021, thereby rejecting his application for emergency parole under Rule 19(1)(C) of the Maharashtra Prisons (Mumbai Furlough and Parole) Rules, 1959.

The learned prosecutor has appeared on behalf of the respondents and submits that the impugned order has been recalled by respondent No.2 and a fresh order has been passed on 21-03-2021, vide which his request for emergency parole has been accepted subject to the prescribed conditions. 3.

A copy of the order dated 21-03-2021 is taken on record, which we are listing at page No.16, to this petition and which is marked as 'X' for identifcation.

In view of the above, the grievance of the petitioner does not survive and this petition stands worked out. 5.
