The petitioner has putforth prayer clause 'B' as under:- B] Hold and declare that the action of the respondent No.3 and 4 cancelling the tender work order dated 03-09-2021 in favour of the petitioner and accepting the newly agency for the work undertaken is illegal, arbitrary and violative of provisions of Article, 14, 19(1)(g) and 226 of the Constitution of India and for that purpose issue necessary orders;

The Hon'ble Supreme Court has delivered
(2) wp4098.22 the judgment on 21-03-2022 in the case of N. G. Projects Ltd. Vs Vinod Kumar Jain and others, AIR 2022 SC 1531.

The learned Advocate for the petitioner submits that the petitioner is aware that only two months are left and his tender work has already been cancelled on 23-02-2022. He, therefore, desires to initiate recovery of damages proceedings against the respondents.

In view of the above, this petition is disposed off with liberty as is available in the light of the judgment delivered by the Supreme Court in the case of N. J. Projects (supra).
