ORAL ORDER :- 1.

We have heard Shri Karkare, learned Advocate for the petitioner and the learned A.G.P. on behalf of the respondent State Authorities.

The grievance of the petitioner is that he is a Project Affected Person. He has passed his H.S.C. at the time the Petition was filed and has acquired qualification of Steno-Typist in English as well as in Marathi. He placed reliance upon the Government Resolution

(2) WP No. 6269/2012 dated 18.07.2008 and prays for employment in Government service on the basis of the said Government Resolution since he is a Project Affected Person.

He, therefore, submits that his representations, which have been filed from 09.10.2010 till 21.07.2011 for employment as a Project Affected Person, may be considered.

Learned A.G.P. has explained to us the Scheme which is to be followed by the Government in the light of the judgment of the learned Full Bench of this Court in the matter of Rajendra Pagare Vs State of Maharashtra and others, 2009 (4) Mh.L.J. 969. 5.

We find that pursuant to the above, the Divisional Joint Registrar, Co-operative Societies has informed the petitioner by communication dated 27.07.2011 that whenever there is an advertisement for filling in Class-III and Class-IV Posts, keeping in view the direction of the Hon'ble Apex Court in Civil Application No. 11646, 11724 of 1996 and in the light of the Government Resolution dated 19.11.2003, the petitioner can make an application and such an application, pursuant to the advertisement, would be considered by the Competent Authority.

In the light of the above, we dispose of this Petition. In the event of any such advertisement in future, the petitioner would

(3) WP No. 6269/2012 be at liberty to make an application and the same would be considered in accordance with the rules and the policies of the Government applicable to the persons who claim to be a Projected Affected.
