Mr. Kolhare, learned counsel for the petitioner submits that the name of the petitioner is kept in the list of surplus candidates however as yet absorption is not made. 2.

Mr. Mali, learned counsel appears for respondent No. 2 and submits that the respondent No. 2 has filed the affidavit and the steps would be taken as per the affidavit.

Respondent No. 2 in his affidavit has stated as under:

2 wp 4545.16 "I say and submit that, now State Government has called the list and information about the surplus teachers from the State and same information is uploading online from the state. I further submit that, the information of the surplus teachers only called by the State Government and they directed to fill-up online information of the surplus teachers. But State Government still does not directed to us for the absorption of surplus teachers. I say and submit that, as an when the necessary directions get by the State Government for absorb the surplus teachers in the service then, deponent is bound to absorb the petitioner in the service."

The Education Officer has accepted that as and when the necessary directions are issued by the State Government for absorption the deponent would absorb the surplus candidates like the petitioner in service.
