DATED : 23 rd April, 2015 PER COURT :- 1] By the present application, the applicant is seeking his release on bail in connection with Crime No. 195 of 2014, registered with Vaijapur Police Station, District Aurangabad, for the offences punishable under Sections 498-A, 306, 304-B, 323, 504, 506 of the Indian Penal Code. 2] I have heard Shri S.A.Gaikwad, learned counsel for the applicant and Smt. V.A.Shinde, learned Additional Public Prosecutor for the respondent/State.

3] The investigation is already over and charge sheet is also filed.

4] The learned Additional Public Prosecutor has invited my attention to the supplementary statement, dated 9.1.2015 wherein the first informant has stated that when deceased Mohini was sitting along with her, after she has delivered a child , that time present applicant had been to her house and raised a suspicion over the character of Mohini. The date of suicide is 23.11.2014. Further, in the entire charge sheet, looking to the general nature of allegations, in the fitness of things, it is necessary to release present applicant on bail,

crap1645.15 since his further custodial presence is not at all necessary. Hence, I pass following order.

O R D E R

(i) Criminal Application is allowed.

(ii) Applicant-Pappusing s/o Rajusing Sattawan be released on bail, in connection with Crime No. 195 of 2014, registered with Vaijapur Police Station, District Aurangabad, for the offences punishable under Sections 498-A, 306, 304-B, 323, 504, 506 of the Indian Penal Code, on he executing P.R. bond in the sum of Rs.10,000/- with one solvent surety in the like amount.

(iii) Bail before the trial court.

(iv) The applicant shall not enter the territorial limits of Banewadi wherein most of the prosecution witnesses are residing, till the trial is over.

(v) Criminal Application is disposed of.
