When this Court has shown disinclination to grant relief in favour of the petitioner, the learned counsel for the petitioner on instructions seeks leave to withdraw the petition.

2. Leave granted. Writ Petition stands dismissed as withdrawn.

3. Learned counsel for petitioner however, seeks clarification that this withdrawal shall not preclude the petitioner to adopt appropriate remedy as provided by the law. He further prays that the time spent in prosecuting the present petition may be excluded.

4. Only because the petitioner has withdrawn this petition, that 1/2

does not preclude him from filing any other proceedings as provided by law. The time spent in prosecution of the present petition to be taken into consideration by the concerned Court, if any proceeding is so filed.
