The learned advocate for the Petitioner submits that the Grandfather of the Petitioner was appointed under the Laud - Page committee recommendations. He was then promoted to the Class-3 category. The learned AGP submits that the Petitioner, who is claiming employment on the basis of Vashila Paddhat, had approached the learned Maharashtra Administrative Tribunal vide Original Application No.415/2015. In the judgment dated 30.06.2016, more specifically below paragraph 6, the learned advocate has relied on the specific condition applicable to the Petitioner that if the bread earner was promoted to the Class-3 category, the Laud - Page committee recommendation would not be applicable to the dependent or the legal heir.

The above position is crystallized. We do not find any reason to cause any interference in the judgment of the learned Tribunal which is based on proper appreciation of the facts and sound principles of law and the specific condition emerging from the Laud - Page committee recommendation. 3.

This Writ Petition is, therefore, dismissed.
