The Petitioner is seeking correction of date of birth in his school record. Consequently, he made an application to the Head Master, Model Urdu Primary School, Parbhani for correction of date of birth. However, Respondent No.2 - the Education Officer refused to entertain the application for correction of change of date of birth, on the ground that the Petitioner has already left the school. The issue as to correction of school record has been considered by the Full Bench of this court in the case of Janabai Himmatrao Thakur vs. The State of Maharashtra and others1, and it is held that the change in the school record is permissible even after the student leaves the school. However, this Court has laid down certain parameters for considering the request for 2019 (6) Mh.L.J.769

In the light of aforesaid exposition of law, the impugned communication would not sustain. We therefore, quash and set aside the impugned communication and direct Respondent No.2 to consider the application submitted by the Petitioner for change of date of birth in his school record, in accordance with law, laid down by this Court in the case of Janabai Himmatraao Thakur vs. The State of Maharashtra and others (supra).

The aforesaid exercise be carried out within a period of eight weeks.

The Writ Petition stands disposed of.
