Per Court :- Present Criminal Application is filed by the applicant for grant of anticipatory bail, since he is apprehending his arrest in connection with CR No. 38/2015 registered with Police Station, Chandan Jhira, District - Jalna, for the offences punishable under Section.s. 379, 511 read with 34 of the Indian Penal Code.
[2] Heard Mr. Suvidh S. Kulkarni, learned counsel for the Applicant and Mr. A.S. Shinde, learned Additional Public Prosecutor for the State of Maharashtra. The learned Additional Public Prosecutor pointed out that, except statement made by the first informant in the First Information Report, there is no other material against the present applicant. [3] Nature of accusation made against the present applicant by the first informant - Yeshwant Aanantrao Mahajan is that, on the spot of
2/2 cri.appln. 1652.15..sxw incident i.e. in the vicinity of village Mandwa, present applicant who is admittedly a Labourer of Sanjay Madan was rolling the barbed wire. [4] In view of nature of the accusation made against the present applicant, custodial presence of the present applicant is not at all required. Hence, I pass the following order :-
ORDER
(i) Criminal Application is allowed.
(ii) In the event of arrest, Applicant - RAMESHWAR @ PINTU WAMANRAO RAJGIRE shall be released on anticipatory bail on he executing P.R. Bond of Rs. 5,000/- [Rs. Five Thousand.] with one solvent surety in the like amount, in connection with CR No. 38/2015 registered with Police Station, Chandan Jhira, District - Jalna, for the offences punishable under Section.s. 379, 511 read with 34 of the Indian Penal Code.
(iii) The Application is disposed of.
