We have perused the findings recorded by the trial Court and in particular, paragraphs 51 and 52 thereof. It appears that the trial Court has not properly appreciated the evidence of injured eye witnesses. In that view of the matter, case is established for allowing the application seeking leave to appeal.

Application is allowed in terms of prayer clauses (A), (B), (C) and (F) and stands disposed of.
