The petitioner is challenging the auction sale notice dated 24.02.2020.

The learned counsel for the petitioner contends that the petitioner has moved for one time settlement that is pending with the Commissioner. The auction sale be stayed.

It appears that the petitioner has also filed the Revision against the recovery certificate before the Divisional Joint Registrar. The petitioner may seek the relief before the Divisional Joint Registrar as may be permissible

2 wp 4112.20 in law. The petitioner may prosecute his application with the Commissioner for one time settlement which the Commissioner would take decision upon it on its own merits.

Writ Petition is accordingly disposed of. No costs.
