PER COURT :- 1.
I have heard the submissions of the learned Advocates for the original petitioner / employee and the respondent / establishment. A communication issued by the establishment to the employee, dated 22.4.2019 is placed on record, by which, it is sought to be conveyed that the establishment has taken a decision to pay Rs.250/- as daily wages to the employee. The learned Advocate for the employee submits that similarly situated employees are being paid a minimum of Rs.10,946/- per month, which is effectively Rs.421/- per day. 2.
Considering the above and the cost of living prevalent, I deem it appropriate to direct the establishment to pay an amount of Rs.300/- akl/d

BENCH AT AURANGABAD 2- CIVIL APPLICATION NO.4305 OF 2019 & ANR per day to the employee. With these directions, Civil Application No. 4305 of 2019 is partly allowed.

The second Civil Application is of 2014, filed by the establishment praying for listing Writ Petition No.6870 of 2009 for final hearing. It is clarified that the 2009 petition is with regard to the order of reinstatement granted in favour of employee by the Labour and Industrial Court. The 2012 petition is filed by the employee, since his ULP Complaint seeking minimum wages, has been rejected by the Industrial Court.

In view of the above, this Civil Application is allowed and Writ Petition No.6870 of 2009 along with Writ Petition No.6937 of 2012 be listed for final hearing on 22.8.2019. If there is any change in the assignment of the Court, the learned Advocates are at liberty to request the Administrative Judge to club both the petitions. ( RAVINDRA V. GHUGE, J. ) ...
