The applicant has been convicted for the offences punishable under Sections 353 and 332 of the Indian Penal Code and sentenced to suffer rigorous imprisonment for three years and to pay fine of Rs.5,000/-, in default to suffer simple imprisonment for one month. He has further been convicted for the offence punishable under Section 323 of the Indian Penal Code and sentenced to suffer rigorous imprisonment for one year and to pay fine of Rs.500/-, in default to suffer further simple imprisonment for fifteen days.

The amount of fine has been deposited. The Trial Court has suspended the substantive sentence of imprisonment until filing of the appeal. Considering the quantum of sentence imposed and the fact that the appeal is not likely to be heard in near future, the execution of substantive sentence of imprisonment to stand suspended pending the appeal. The applicant be released on his executing P.R. bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) with surety in the like amount. 4.

Criminal application stands disposed of.
