The petitioner claims benefit of Assured Career Progression Scheme considering his date of appointment as of the year 2000. The petitioner is possessing qualification of B.A., B.P.Ed. on the date of appointment. The respondents pursuant to the directions of this Court considered the representation of the petitioner and under order dated 06.10.2016 granted the pay scale of trained primary teacher to the petitioner from the initial date of appointment i.e. 20.10.2000. 2.

As the respondents have considered the petitioner as a trained primary teacher from 20.10.2000 the twelve years will have to be counted from the initial date of appointment.

In the light of the above, the impugned order is set aside. The respondents shall consider the petitioner as a trained primary teacher from his initial date of appointment i.e. 20.10.2000 and consider the claim of the petitioner for ACPS expeditiously and preferably within a period of six (06) months from today.

Writ petition is disposed of. No costs.
