These Petitioners are employees of Respondent Nos.2 and 3 which is a private education society running two engineering colleges. They have issued a notice in Form-I under Rule 7(1) of the Payment of Gratuity (Central) Rules, 1972 (hereinafter referred to as 'Rules-1972') on 29.11.2021. Yet, the gratuity amount is not being paid.

The Petitioners are entitled to file an application before the controlling authority under Rule 10 of the Rules-1972 by preferring the proceedings in from 'N'.

In view of the above, with liberty to avail of the remedy as is available under the Payment of Gratuity Act, 1972 and the Rules framed thereunder, this Petition is disposed off.

At this juncture, the learned Advocate for the Petitioners submits that the representation dated 29.11.2021 filed with the Management, may be decided within a particular period.

Let the Management consider the said representation, expeditiously.
