The petition is presented raising challenge to the order rendered by the learned Judicial Magistrate First Class, Patoda below Exh. 87 in Regular Criminal Case No. 67 of 2019, for the offence punishable under Sections 498, 504 and 506 read with 34 of the Indian Penal Code. The petitioner preferred the application for issuance of non-bailable warrant against the accused persons i.e. respondents No. 2 to 6 herein. The learned Magistrate has rejected the application on the ground that the application has been filed at belated stage and the matter is pending for recording of evidence of witnesses.
