Heard the learned counsel for the applicant and the learned A.P.P. for the respondent/State.

The applicant is seeking bail in C.R.No.81 of 2022 registered with Anandnagar Police Station, District Osmanabad, for the offence punishable under Sections 302 and 201 read with Section 34 of the Indian Penal Code.

Perused the chargesheet. Except the statement of the coaccused, there is no incriminating evidence against the applicant. He was not seen lastly in the company of the deceased. The sole witness auto-rickshaw driver also did not identify him in test identification parade. There were no antecedents to his discredit. Considering the role attributed to him and particularly having no

935-BA-525-23.odt antecedents to his discredit, he deserves bail. Hence, the following order :- i) Application is allowed.

ii) Applicant Shivshankar Haribhau Ingale be released on bail, on furnishing PB and SB of Rs.50,000/-, with one solvent surety of the like amount, in C.R.No.81 of 2022 registered with Anandnagar Police Station, District Osmanabad, for the offence punishable under Sections 302 and 201 read with Section 34 of the Indian Penal Code, on the conditions that, (a) He shall not tamper with the prosecution witnesses. (b) He shall attend the trial on each and every effective date.
