The applicant is apprehending arrest in connection with Crime No. 41/2021 registered with Ambajogai City Police Station, District Beed for the offence under Section 420 of the Indian Penal Code.

Complainant had alleged that the complainant and others had invested amount with the accused company, however the promises were not fulfilled. The complainant did not receive any returns. 3.

Learned counsel for the applicant submits that apart from the complainant there are three other aggrieved persons. There is settlement between the parties. The complainant and three other aggrieve persons have no objection for allowing this application. The complainant had filed affidavit before the Sessions Court.

The complainant has also filed application seeking permission to assist the P.P. In the said application, it is submitted that there is settlement between the complainant and applicant. Three other aggrieved persons namely Gautam Kadam, Vijay Shinde and Sudip Zirmire are represented by Advocate. He has tendered their affidavit in which it is stated that it is mutually decided between the applicant and deponent that the dispute is settled. Affidavit executed by three other aggrieved persons are tendered. It is not disputed by the prosecution that these persons, complainant and three other persons were aggrieved by the act of the accused. The affidavits are taken on record and marked X, X1 and X2 for the purpose of identification. In view of that the application can be allowed. Hence, I pass the following order :-

O R D E R

i.

Anticipatory Bail Application No. 324/2021 is allowed. ii.

In the event of arrest of the applicant in Crime No.41 of 2021 registered with Ambajogai Police Station, the applicant be released on bail on executing PR bond in the sum of Rs.25,000/- with one or more sureties in the like amount;

iii.

Application stands disposed of.
