Mr. Bhumkar, the learned counsel for the petitioners submits that the petitioner is entitled for the promotional pay scale of Junior Engineer with effect from 1.10.1994. According to the learned counsel, representation is also given to the respondent (Exh.'F') collectively and entitlement of the aspect of the petitioner cannot be questioned in view of the judgment of this Court at Nagpur in case of similarly situated employees delivered in Writ Petition No.1434/2009.

Learned counsel for respondent Zilla Parishad submits that, if the representation is pending, same would be decided in accordance with law. In the result, we pass following order.

O R D E R

The respondent No.2 shall decide the representation Exh.'F' collectively, on its own merits in accordance with law considering all the legal aspects and judgment delivered by this Court expeditiously preferably within FOUR MONTHS from today. Petitioner is at liberty to appear before the respondent No.2 and produce the relevant judgment. No costs.
