The petitioners have put forth prayer clause (B), which reads as under :- "(B) By issuing writ of mandamus or any other appropriate writ or direction in like nature, the respondent No.1 may kindly be directed to regularize the encroachment of petitioners over the plot No. 128 and 136 of village Kherda Tq. Kallamb Dist. Osmanabad as per the provisions of M.L.R. code." 2.

It is informed that the petitioners have already preferred a Regular Civil Suit bearing No.359/2021, claiming that they are not encroachers.

On instructions, the learned Advocate for the petitioners prays for withdrawal of this petition.
