PER COURT :- 1.

The petitioner challenges the order dated 08/01/2025 passed by the Trial Court, whereby the application filed for recalling the 'no W.S. order' has been rejected.

The 'no W.S. order' was passed on 22/01/2022. The applicant had appeared in the petition on 30/04/2019 but did not file his written statement, resulting in the passing of the 'no W.S. order' on 22/01/2022. Thereafter, on 29/07/2024, he filed an application seeking recall of the said order. The reasons stated for the delay were the COVID-19 pandemic and alleged compromise talks between the parties. The Trial Court observed that the COVID-19 period pertained to the years 2019-2020 and that no material was produced to substantiate the alleged compromise talks. There is an unexplained delay of four years in filing the written statement. It is also noted that there is delay in filing written statement in the application filed bythe Page 1 of

970 WP 4484-2025 respondent wife under Section 9 of the Hindu Marriage Act for Restitution of Conjugal Rights.

In view of the above, no case is made out for interference with the order passed by the Trial Court. The petition, therefore, stands dismissed. ( ARUN R. PEDNEKER, J. ) vj gawade/-.
