Heard the learned counsel for the applicant and the learned A.P.P. for the respondent/State.

Two Kilograms Ganja has been recovered from the conscious possession of the applicant. Since it is not commercial quantity, Section 37 of the Narcotic Drugs and Psychotropic Substances Act, 1985, would not attract. There are no antecedents to the discredit of the applicant. The alleged contraband has been seized. The material investigation has been completed. In the circumstances, the applicant deserves bail. Hence, the order :- i) Application is allowed.
940-BA-523-23.odt ii) Applicant Shaikh Abdul Shaikh Dadamiya be released on bail, on furnishing PB and SB of Rs.50,000/- with one solvent surety of the like amount, in Crime No.20 of 2023, registered with Kotwali Police Station, Parbhani, for the offence punishable under Sections 8(c) and 20(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985, on the conditions that;
(a) He shall attend the police station as and when called by the Investigating Officer on written notice till filing the chargesheet.
(b) He shall not involve in the similar offence.
