It is a death claim. The appellant appears to have not participated in the proceedings before learned Commissioner although he filed written statement. A copy of the police statement is placed on record, wherein he admits to have been a builder by profession. It is also evident from his statement that the deceased was working on his construction site.

In the fitness of things, the applicants are permitted to withdraw Rs.4,00,000/- (Rupees Four Lakhs) in deposit with the Commissioner, on furnishing usual undertaking. The application stands disposed of accordingly.
