Delay of 1132 days has occurred in filing the present appeal by the State, in exception to the award passed in L.A.R. No. 676 of 2006 decided by the District Court at Beed.

The learned A.G.P. submitted that after the decision rendered by the reference Court, approval was sought from the Law and Judiciary, whether to file appeal in the matter. Learned AGP further submitted that on 13/12/2010, the sanction was received from the Law & Judiciary and, thereafter, arp/

BENCH AT AURANGABAD taking all prompt steps, the appeal has been filed. Learned A.G.P. submits that the delay has been caused in making the procedural compliances and is un-intentional.

Though, the respondents i.e. original claimants are duly served, they have not entered appearance.

Considering the reasons assigned for occurrence of the delay, which according to me, are just and sufficient, the delay is condoned. The Civil Application is allowed and disposed of. Appeal be registered in accordance with law.

Issue notice to the respondents, after registration of the appeal, returnable eight (8) weeks thereafter.
