ORDER :

The application is filed for bail. The previous application of the present applicant filed for bail in this Court was withdrawn.

The present application is filed on the ground that delay is caused in disposal of the case and the applicant has been behind bars for more than two and half years. The submissions made show that on the last date, the Investigating Officer was under examination as a witness. This circumstance shows that the last witness of the prosecution is being examined. It appears that though the last witness was under examination, the next date is given as 25.4.2017. It is surprising and shocking that when the case is on the verge of the completion, such longer date is given. The provisions of section

Cri.Appln.No. 1585/17 309 of Cr.P.C. are not followed in letter and spirit. It appears that two accused persons are in jail and the remaining three accused persons are on bail.

In view of these circumstances, this Court holds that direction needs to be given to the Trial Court to dispose of the matter expeditiously and in any case, within 45 days from today. The application is disposed of in aforesaid terms. The learned Judge may pre-pone the date for expeditious disposal of the matter.
