CORAM :

R.M.BORDE & P.R.BORA,JJ.

DATE :

th August, 2015.

PER COURT :- 1) Heard. It is not a matter of dispute that the grievances raised by the petitioners have been scrutinized by One-man Commission, comprising of Justice A.B.Palkar, appointed by the Hon'ble Apex Court. Acting upon the recommendations contained in the Inquiry Report made by the one-man Commission, the decision, to cancel freedom-fighters pension and other allied benefits, has been taken by the State Government, since it was noticed that there were several lapses and irregularities in the matter of deciding the pension claims of the freedom-fighters.

WP No.7250/2011 & Ors.

2) The challenge raised to the report of Inquiry made by Justice Palkar Commission, has also been turned down by the Hon'ble Apex Court, as such, the recommendations made in the Inquiry Report by the Commission, attained finality.

3) It would not be appropriate to reinvestigate the factual aspects which have already been dealt with by the one-man commission and challenge to Inquiry report of the Commission has been turned down by the Hon'ble Supreme Court. 4) In this view of the matter, the challenge in the instant petition need not be scrutinized once again. The writ petition is devoid of substance and the same stands dismissed.
