By this petition, petitioner has assailed order dated 01.02.2019 passed by the Jt. Civil Judge Junior Division, Rahata thereby allowing plaintiffs application at Exh.81 for amendment. 2.

The reasons cited for moving application for amendment of the plaint was filing of additional written-statement by defendant no.1.

I have perused the original written-statement filed by defendant no.1. On 23.02.2018 defendant no.1 filed a detailed and comprehensive additional written-statement with various pleas which were never raised earlier. This trigerred necessity of amending the plaint. The amendment has rightly been allowed by the trial Court.

There is no infirmity in the order passed by the trial Court. The petition is devoid of merits and the same is dismissed without any orders as to costs.
