Petitioner has challenges order dated 10/10/2016. Learned counsel Mr. Shinde fairly submitted before us that based on the communication order dated 10/10/2016 the institute submitted fresh proposal to the Education Officer on 11/11/2016 along with all the necessary documents. It is submitted by learned counsel Mr. Shinde that fresh proposal, takes case of deficiency pointed out in earlier proposal. Mr. Shinde submits that fresh proposal dated 11/11/2016 is pending before the Education Officer for decision and as the petitioner was waiting under a bona-fide impression that the Education Officer may decide proposal sooner or later.

The petitioner approached this Court seeking directions to the respondent Education officer to decide proposal dated 11/11/2016 expeditiously and within a stipulated period. 4.

Considering this fact circumstance, the petition is taken up for disposal. Notice to only respondent No.1. Learned AGP waives notice for respondent No.1. It may not be necessary for us to call upon respondent Nos. 2 to 4 by issuing notice as the order passed is innocuous.

Respondent No.2 - Education Officer (Primary), Zilla Parishad, Jalna to decide the proposal dated 11/11/2016 as expeditiously as possible and not later than twelve weeks from the date of receipt of the order of this Court.

Parties to act upon an authenticated copy of this order. 7.

The petitioner to submit an authenticated copy of this order to the Education Officer (Primary), Zilla Parishad, Jalna for necessary compliance.

Writ petition is accordingly disposed of.
