BENCH AT AURANGABAD 121 FIRST APPEAL NO.1514 OF 2013 THE STATE OF MAH AND ANR

VERSUS

SHAIKH KARIM SHAIKH ABDUL, DIED THR. L.RS. SHAIKH KADIR AND ANR ...

CORAM:

VIMALNATH S. TIWARI REGISTRAR (JUDL) DATED: 28/06/2022 1.

This Court on 14/06/2022 granted two weeks time to the office of the Government Pleader to take necessary steps, so as to remove the office objections. The said time was granted specifically on the request made by the representative of the Government Pleader's Office as no counsel appeared for the State. Today, also the position remains the same. There is no office objection removed nor there appears to have any steps taken, in this regard, to serve the notice on Respondent No. 1 and 2 which remained unserved on the given address. Today none appeared on behalf of State despite waiting for sometime. On previous date time was granted with a condition that if necessary steps are not taken to serve respondent No. 1 and 2, appropriate order shall be 121 FIRST APPEAL NO.1514 OF 2013

passed. Thus, it appears that the State is not keen in pursuing this matter by taking necessary steps and therefore, it is a fit case to be dismissed against respondents and the same is thus dismissed accordingly.
