After having heard respective Counsel in the matter, in my opinion, the order passed below Exh.94, in Regular Civil Suit No.374 of 2005, on 7th January, 2014, by 4th Joint Civil Judge Junior Division, Osmanabad, does not warrant any interference. Accordingly, petition stands disposed of with liberty to petitioner-original defendant no.2 to canvass the said issue at the time of final hearing of the suit.
