The applicant has been convicted for the offence under Section 376(2)(i) read with Section 511 of the Indian Penal Code vide under Section 235(2) of the Code of Criminal Procedure and sentenced to suffer rigorous imprisonment for five years and shall pay fine of Rs.5,000/-, in default, to to suffer rigorous imprisonment for six months. The applicant is held guilty of committing offence under Section 9(m) punishable under Section 10 read with 18 of the Protection of Children from Sexual Offence Act.

When he was juvenile conflict with law, he was just 17 years of age. Considering this fact, I am inclined to allow the application.

The application is allowed in terms of prayer clause [B]. 5.

The applicant be released on his executing P. R. bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) with one surety in the like amount.

Bail before the trial Court.
