This application is for transfer for proceeding bearing P. A. No. 138/2021 filed by the Respondent/husband before Family Curt, Amravati for seeking divorce.

It is the contention of the Applicant that she had filed proceedings before Family Court, Dhule bearing Petition E No. 365/2021. Applicant further claims that she is unemployed and has responsibility of 5 years old daughter. Considering the distance of about 275 kms from Dhule to Amravati, she finds it difficult to attend the said proceeding at Amravati. Resultantly, she shall not be in a position to defend herself properly in the said proceeding.

Record indicates that Respondent is duly served. However, he is absent, which shows that he is not inclined to oppose the application.

Since the contention raised by Applicant is not controverted by Respondent, this Court finds it appropriate to allow the application. There is reason to believe that owing to the difficulties put forth by Applicant, she would not be able to defend the proceeding at Amravati and thereby her right would get jeoparadise. Hence, application is allowed in terms of prayer clause 'B'. Parties are directed to appear before the Family Court, Dhule on 08.07.2024.
